These Terms & Conditions ("Terms") govern your use of the thejobspulse service (the "Service"), operated by TheJobsPulse ("TheJobsPulse", "we", "us", "our"). By accessing or using the Service, you agree to these Terms. If you do not agree, do not use the Service.

1. The Service

TheJobsPulse provides AI-assisted tools to generate ATS-optimized resumes and skill-gap learning plans from job postings and user-uploaded resumes.

2. Eligibility and accounts

You must be of legal age in your jurisdiction to use the Service. If you use the Service on behalf of an organization, you represent that you have authority to bind that organization. You are responsible for maintaining the confidentiality of your account credentials and for all activity under your account, and you must provide accurate information and keep it up to date.

3. Acceptable use

You agree not to:

  • Use the Service for any unlawful purpose, or for fraud, spam, or deception.
  • Infringe the intellectual property, privacy, or other rights of any person.
  • Interfere with the security or integrity of the Service, including by introducing malware, probing for vulnerabilities, or scraping at scale.
  • Reverse engineer, resell, or redistribute the Service, or circumvent any technical limits.
  • Submit content you do not have the right to use.

4. AI outputs and accuracy

Outputs generated by the Service (including parsed resumes, ATS rewrites, and skill-gap reports) are produced by AI and may be inaccurate or incomplete. You are responsible for reviewing and verifying any output before relying on it. The Service is not a substitute for professional career, legal, or financial advice.

5. Your content

You retain ownership of resumes and other content you upload. You grant TheJobsPulse a limited, non-exclusive license to host, store, and process your content solely to provide the Service to you.

6. Intellectual property

TheJobsPulse retains all rights, title, and interest in and to the Service, including its software, design, and branding. We grant you a limited, non-exclusive, non-transferable right to use the Service in accordance with these Terms.

7. Payments, subscriptions, and refunds — Merchant of Record

Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.

Payment, billing, taxes, subscription renewals, cancellations, and refunds for paid plans are handled by Paddle in accordance with Paddle's Buyer Terms and our Refund Policy. Paid subscriptions renew automatically until canceled. You can cancel at any time through Paddle's customer portal (paddle.net).

8. Service availability

We strive to keep the Service available but do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law, the Service is provided "as is" and we disclaim all implied warranties, including merchantability and fitness for a particular purpose.

9. Limitation of liability

To the fullest extent permitted by law, TheJobsPulse's aggregate liability arising out of or relating to these Terms or the Service shall not exceed the fees you paid in the twelve months preceding the event giving rise to the claim. We are not liable for indirect, consequential, special, or incidental damages, including loss of profits, data, or goodwill. Nothing in these Terms limits liability for fraud, death, personal injury, or any liability that cannot be excluded by law.

10. Indemnity

You agree to indemnify TheJobsPulse for claims arising from your content, your unlawful use of the Service, or your breach of these Terms.

11. Suspension and termination

We may suspend or terminate access for material breach of these Terms, non-payment, suspected fraud or security risk, or repeated or serious policy violations. On termination, your right to use the Service ends and we may delete your data after a reasonable export window.

12. Changes to the Service or Terms

We may modify the Service or these Terms from time to time. Material changes will be communicated through the Service or by email. Continued use after changes take effect constitutes acceptance.

13. Governing law and disputes

These Terms are governed by the laws of the jurisdiction in which TheJobsPulse is established, without regard to conflict-of-law rules. Disputes shall be resolved in the courts of that jurisdiction, subject to mandatory consumer protections available to you locally.
